Terms of Service for Pluck - Video Notes to Notion

These Terms of Service govern the use of the Pluck browser extension ("the Service"). By installing, accessing, or using Pluck, users agree to be bound by these terms. Users who do not agree must uninstall the extension.
1. Description of Service
Pluck is a productivity tool designed to capture, annotate, and sync YouTube video frames and notes directly to a user's Notion workspace. The Service operates locally within the browser, functioning as a bridge between the browser, YouTube, and Notion. No user data, notes, or credentials are stored on external developer servers.
2. Service Availability and "As-Is" Provision
The Service is provided strictly on an "as-is" and "as-available" basis. Pluck relies entirely on the Application Programming Interfaces (APIs) and infrastructure of third-party platforms, specifically YouTube and Notion. Because external system updates, API deprecations, and service outages are entirely outside the Developer's control, no promises or guarantees are made regarding uninterrupted functionality, error-free operation, or the permanent safeguarding of synchronized data. Users utilize the tool at their own discretion and risk.
3. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer disclaims financial and legal responsibility for issues arising from the use of the Service.
- Zero Financial Liability: For users utilizing the free version of Pluck, the Developer’s maximum aggregate liability for any reason is strictly limited to $0.00.
- No Damages: The Developer is not liable for indirect, incidental, special, or consequential damages, including but not limited to data loss, account suspension by third parties, lost profits, or lost productivity.
- Sole Remedy: If a user is dissatisfied with the Service or encounters operational failures, the sole and exclusive remedy is to discontinue use and uninstall the extension.
4. User Responsibilities and Indemnification
Users are solely responsible for their conduct while utilizing Pluck. This includes maintaining the security of connected accounts and strictly adhering to the respective Terms of Service of both Notion and YouTube.
By using the Service, users assume full responsibility for the content they capture and sync. Users agree to indemnify and hold the Developer harmless from any legal claims, damages, liabilities, or expenses (including reasonable attorneys' fees) resulting from misuse of the extension, violation of third-party terms, or infringement of intellectual property and copyright.
5. Modifications and Termination
The Developer reserves the right to modify, suspend, or terminate the Service, or restrict access to it, at any time and without prior notice. In the event a paid subscription tier is introduced in the future, these Terms will be updated accordingly.
